Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("you," "member," or "user") and Early Childhood Professionals Circle, LLC ("ECPC," "we," "us"), a Florida limited liability company, governing your access to and use of the ecpcircle.org website, membership, courses, community, and related services (the "Platform"). By creating an account, clicking "I agree," or using the Platform, you accept these Terms. If you do not agree, do not use the Platform.
1. Eligibility & Accounts
• You must be at least 18 years old to create an account. The Platform is intended for early-childhood professionals and organizations, not for children.
• You are responsible for the accuracy of your registration information, for keeping your password confidential, and for all activity under your account.
• One account per person unless ECPC agrees otherwise. Organization/employer accounts are governed additionally by the Organization Account Terms.
2. Membership Tiers & Benefits
ECPC offers a free Community Member tier and paid tiers (e.g., Professional Educator and higher), plus organization accounts. Benefits, features, and pricing for each tier are described at ecpcircle.org/pricing and may change over time; we will give reasonable notice of material changes. Benefits are personal to the member and may not be shared, resold, or transferred.
3. Fees, Billing & Automatic Renewal
Paid memberships are billed on a recurring basis and renew automatically until cancelled. Complete billing, renewal, price-change, and consent terms are in the Membership, Billing & Auto-Renewal Terms, which is incorporated into these Terms. By purchasing a paid membership you provide express affirmative consent to recurring charges as described there.
4. Cancellation & Refunds
You may cancel at any time as described in the Refund & Cancellation Policy, incorporated here. Cancellation stops future renewals; access continues through the end of the paid period unless stated otherwise.
5. License to Use ECPC Content
Subject to these Terms and payment of applicable fees, ECPC grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use ECPC's courses, videos, resources, and materials for your own professional development. You may not: copy, redistribute, publicly display, resell, sublicense, scrape, or create derivative works from ECPC content; share your login; or use the content to build a competing offering. All ECPC content and trademarks remain the property of ECPC or its licensors.
6. Member-Submitted Content
You retain ownership of content you post (discussions, reviews, uploads) but grant ECPC a worldwide, royalty-free, non-exclusive license to host, display, and use it to operate and promote the Platform. You are solely responsible for what you post and represent that you have the rights to post it. ECPC may remove content and suspend or terminate accounts for violations.
7. Professional Development — No Guarantee of Credit
ECPC provides professional development, not accredited credentials. ECPC does not guarantee that any course, certificate, or hours will be accepted toward licensure, a state registry, QRIS, CDA renewal, or any employer or regulatory requirement. You are responsible for confirming acceptance with your own state agency, registry, or employer before relying on it.
8. Disclaimers & Limitation of Liability
The Platform and all content are provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. ECPC does not warrant that the Platform will be uninterrupted, error-free, or secure. To the maximum extent permitted by law, ECPC's total liability will not exceed the greater of (a) the amount you paid ECPC in the 12 months before the claim, or (b) $100. ECPC is not liable for indirect, incidental, consequential, or punitive damages, or for conduct of other members or third parties.
9. Indemnification
You agree to indemnify and hold ECPC harmless from claims arising out of your use of the Platform, your content, or your violation of these Terms or applicable law.
10. Suspension & Termination
ECPC may suspend or terminate your account for non-payment, violation of these Terms or ECPC policies, or conduct harmful to the community or Platform. You may terminate by cancelling and closing your account. Sections that by their nature should survive (IP, disclaimers, liability limits, dispute resolution) survive termination.
11. Changes to These Terms
ECPC may update these Terms. We will post the updated version with a new "Last updated" date and, for material changes, provide reasonable notice (e.g., email or in-app). Continued use after changes take effect constitutes acceptance.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Platform will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and ECPC each waive the right to participate in a class action, class arbitration, or other representative proceeding. You may opt out of this arbitration provision within 30 days of first accepting these Terms by emailing [email protected] with the subject line "Arbitration Opt-Out."
13. Miscellaneous
These Terms, together with the incorporated policies, are the entire agreement between you and ECPC. If any provision is unenforceable, the rest remains in effect. ECPC's failure to enforce a provision is not a waiver. You may not assign these Terms; ECPC may.
